Acceptable Use Policy
Unacceptable Use
Athlete Initiative is about confronting the issue of sexual misconduct and creating a safer campus experience. As such, we extend those ideals to what is considered acceptable use of our Website. The examples listed in this policy are not exhaustive. Prohibited uses and activities include, without limitation, any use of the Website in a manner that, in Athlete Initiative’s reasonable judgment, involves, facilitates, or attempts any of the following:
Violations of Law
Violating any law of, or committing conduct that is tortuous or unlawful in, any applicable jurisdiction; advocating or encouraging violence against any government, organization, group, individual or property, or providing instruction, information, or assistance in causing or carrying out such violence, regardless of whether such activity is unlawful;
Abusive Behavior
Harassing, threatening, or defaming any person or entity; contacting any person who has requested no further contact; using ethnic or religious slurs against any person or group; displaying, performing, sending, receiving or storing any content that is obscene, pornographic, lewd, lascivious, or excessively violent, regardless of whether the material or its dissemination is unlawful; holding Athlete Initiative or its affiliates up to public scorn or ridicule;
Intellectual Property
Infringing upon the copyrights, trademarks, trade secrets, trade names, service marks, right of publicity, patent, or other intellectual property rights of any person or entity; deleting or altering author attributions, copyright notices, or trademark notices, unless expressly permitted in writing by the owner;
Privacy
Violating the privacy rights of any person; Collecting or disclosing any personal address, social security number, or other personally identifiable information without each holder’s written permission; cooperating in or facilitating identity theft; transmitting highly sensitive personal information of an individual in a manner that can be associated with the individual, such as Social Security number, government-issued identification number, health or medical information, credit card or debit card number, financial account information, access codes and PINS, or date of birth;
Hacking, Viruses, & Network Attacks
Accessing any computer or communications system without authorization; Attempting to penetrate or disable any security system; intentionally distributing a computer virus, launch a denial of service attack, or in any other way attempt to interfere with the functioning of any computer, communications system, or website; attempting to access or otherwise interfere with others; obtaining unauthorized access to any system, network, service, or account; interfering with service to any user, site, account, system, or network by use of any program, script, command, or otherwise; introducing or activating any viruses, worms, harmful code and/or Trojan horses;
Spam
Sending bulk unsolicited e-mails (“Spam”) or sell or market any product or service advertised by or connected with Spam; facilitating or cooperate in the dissemination of Spam in any way; violating the CAN-Spam Act of 2003; sending or posting unsolicited messages or e-mail, whether commercial or not, a) to any recipients who have requested that messages not be sent to them, or b) to a large number of recipients, including users, newsgroups, or bulletin boards, at one time; evading spam filters, or sending or posting a message or e-mail with deceptive, absent, or forged header or sender identification information;
Fraud
Issuing fraudulent offers to sell or buy products, services, or investments; misleading anyone about the details or nature of a commercial transaction; committing fraud in any other way; reselling Athlete Initiative’s services, in whole or in part, to any entity or individual, without Athlete Initiative’s prior written consent; or misrepresenting your relationship with Athlete Initiative.
Generally
Athlete Initiative requires that everyone conduct themselves with respect for others.
Consequences of Violation
Violation of these terms may lead to suspension or termination of the user’s account or legal action. In addition, the user may be required to pay for the costs of investigation and remedial action related to violations. Athlete Initiative reserves the right to take any other remedial action it sees fit.
Reporting Unacceptable Use
Athlete Initiative requests that anyone with information about a violation of these terms report it via email to the following address: contact@athleteinitiative.org . Please provide the date and time (with time zone) of the violation and any identifying information regarding the violator, including email or IP (Internet Protocol) address if available, as well as details of the violation.
Website Access and License
Any users who comply with these terms are granted a limited, non-exclusive, nontransferable license to access and make use of the information located on the Website. Use of other Athlete Initiative services will be subject to their terms.
This license does not include any resale or commercial use of any Website content; any collection and use of any data listings, descriptions, measures or metrics; any derivative use of any Athlete Initiative service or its contents; any downloading, copying, or other use of account information for the benefit of any third party; or any use of data mining, robots, or similar data gathering and extraction tools.

Feedback
If you suggest any new features, functionality, or improvement to Athlete Initiative’s Website or services, you acknowledge that all Feedback and any incorporation of such Feedback are the sole and exclusive property of Athlete Initiative. Legal Terms and Conditions
Governing Law and Venue
This Website shall be governed exclusively by the laws of the State of California, without regard to its conflicts of laws rules. Each party hereby consents to the exclusive jurisdiction of the state and federal courts located in San Diego, California to adjudicate any dispute arising out of or relating to this Website. Resolution will be pursued by binding arbitration first, rather than in court. The Federal Arbitration Act and federal arbitration law apply to this agreement.
Notice and Procedure for Claims of Copyright Infringement
Athlete Initiative respects the intellectual property of others. If you believe that your work has been copied in a way that constitutes copyright infringement, please report it via email to the following address: contact@athleteinitiative.org.
Severability
Please review our other policies. These policies also govern your use of the Website. If any of these terms shall be deemed invalid, void, or for any reason unenforceable, that condition shall be deemed severable and shall not affect the validity and enforceability of any remaining term or condition.
