Athlete Initiative collects certain information through our website.  This page (“Privacy Policy”) lays out our company’s policies and procedures surrounding this information.

This Privacy Policy applies only to the Website.  It does not apply to any third-party site or service linked to the Website or recommended or referred to by the Website, through the Company’s products or services, or by the Company’s staff.  It does not apply to any other website, product, or service operated by the Company, or to any of the Company’s offline activities.

Athlete Initiative allows for contact from You through our website.  We ask for Your name, email address, university affiliation, organizational affiliation, and for any other information provided.   

Protection of Collected Information

Athlete Initiative will implement and maintain commercially reasonable technical, physical, and administrative safeguards to protect the security and confidentiality of collected data. We will take reasonable steps to prevent a virus or other malware from being transmitted from our systems to you through the Website.  By using the Website, You acknowledge that it is at Your own risk. 

Confidentiality

Except as otherwise provided herein, any and all collected data is confidential.   

A disclosure of collected data shall not be a violation of this provision if it is legally compelled to be disclosed pursuant to a subpoena, summons, order or other judicial or governmental process, provided the disclosing party provides prompt notice of any such subpoena, order, etc. to the other party so that such party will have the opportunity to obtain a protective order. 

Access to Collected Information

Use of Data

Athlete Initiative may monitor any and all use of the Website.  We may use the collected data for business purposes, including, but not limited to, the identification of trends and the formulation of statistics, and may disclose the same, provided that in connection with such use or disclosure, (i) such data and information are aggregated and do not identify individual users, and (ii) such data and information shall not be identifiable as originating from user. 

Athlete Initiative will use collected data to the extent necessary to enforce the Terms of Use and to prevent imminent harm to persons or property.  

Third Party Access

Athlete Initiative does not allow third party access to collected data, except as set forth in this Privacy Policy. 

Governing Law and Venue

Governing Law

This Privacy Policy is deemed to be made under and shall be interpreted in accordance with the Applicable Laws of the State of California, excluding its conflict of laws provisions. “Applicable Laws” means all laws, ordinances, rules, regulations, orders, licenses, permits, judgments, decisions or other requirements of any governmental authority in any territory that has jurisdiction over the parties, whether those laws, etc., are in effect as of the Effective Date or later come into effect during the term of this Agreement. 

Governing Venue

Any lawsuit or proceeding relating to this Agreement shall be brought only in the state and federal courts located in San Diego, California and both parties hereby submit to the jurisdiction of such courts.  

California Online Privacy Protection Act (“CalOPPA”)

User’s CalOPPA Rights

According to CalOPPA, the Company agrees to the following:

(i)      Users can visit our site anonymously;

(ii)    once this Privacy Policy is created, we will add a link to it on our home page or as a minimum, on the first significant page after entering our website;

(iii)   our Privacy Policy link includes the word ‘Privacy’ and can easily be found on the page specified above;

(iv)   User will be notified of any Privacy Policy changes on our Privacy Policy Page; and

(v)     User can change User’s personal information by logging in to their account. 

Children Online Privacy Protection Act (“COPPA”)

COPPA puts parents in control of the collection of personal information from children under the age of 13 years old.  The Federal Trade Commission, United States’ consumer protection agency, enforces the COPPA Act, which spells out what operators of websites and online services must do to protect children’s privacy and safety online.   

The Controlling the Assault of Non-Solicited Pornography and Marketing Act (“CAN-SPAM Act”)

The CAN-SPAM Act is a law that sets the rules for commercial email, establishes requirements for commercial messages, gives recipients the right to have emails stopped from being sent to them, and spells out penalties for violations. 

CAN-SPAM Act Compliance

Athlete Initiative collects email addresses to send information, respond to inquiries, and/or other requests or questions.  According to the CAN-SPAM Act, the Company agrees to the following:

(i)      not use false or misleading subjects or email addresses;

(ii)    identify the message as an advertisement in some reasonable way;

(iii)   include the physical address of our Company or site headquarters;

(iv)   monitor third-party email marketing services for compliance, if one is used;

(v)     honor opt-out/unsubscribe requests quickly; and

(vi)   allows Users to unsubscribe by using the link at the bottom of each email. 

Fair Information Practices Principles. 

A “Security Incident” means any loss of, or unauthorized access, acquisition, use or disclosure of collected data that is in Athlete Initiative’s possession or control.  

Notification

If Athlete Initiative becomes aware of a Security Incident, it will notify those affected without undue delay, and in no event later than seven (7) days following the discovery of any such Security Incident. The Company will cooperate fully in providing those affected with any information it may reasonably request relating to the Security Incident and the related investigation and remediation efforts. 

Individual Redress Principle

Those affected have the right to legally pursue enforceable rights against data collectors and processors who fail to adhere to the law. This principle requires not only that those affected have enforceable rights against data collectors, but also that Users have recourse to courts or government agencies to investigate and/or prosecute non-compliance by data collectors.

Amendments

Athlete Initiative may revise the Privacy Policy at any time by posting a new version on the Website, and such new version will become effective on the date it is posted.
